These Know Your Pet DNA® Terms and Conditions (“Terms”) govern your access to and use of the Know Your Pet DNA® websites, products, and services (collectively, the “KYPD Services”), which are operated by BioPet Vet Lab, Inc. (“BioPet,” “we,” “us,” or “our”). By purchasing, registering, or using the KYPD Services, you agree to be bound by these Terms and by the Know Your Pet DNA Privacy Policy, which is incorporated by reference. If you do not agree, you may not use the KYPD Services.
Eligibility and Account Responsibilities
The KYPD Services are intended for individuals who have reached the age of majority in their jurisdiction of residence. Children under the age of 13 may not create accounts.
You agree to:
- Provide accurate, current, and complete information when creating or using a KYPD account
- Maintain the confidentiality of your login credentials
- Be responsible for all activity that occurs under your account
You must notify BioPet promptly if you believe your account has been accessed without authorization.
Nature and Purpose of the Services
Know Your Pet DNA provides genetic information about pets, which may include breed composition, traits, parentage, and certain health-related genetic markers. The KYPD Services are provided for informational and recreational purposes only. They are not a substitute for professional veterinary care, diagnosis, or treatment and are not intended to predict medical outcomes. You should always consult a licensed veterinarian regarding your pet’s health.
DNA Sample Submission
By submitting a DNA sample, you represent and agree that:
- The sample is from your pet and not from any other animal or source
- You are authorized to submit the sample
- You will not submit samples in violation of applicable laws or export restrictions
- Once submitted, DNA samples and any extracted DNA cannot be returned
BioPet may store or destroy samples as described in the Privacy Policy.
Use and Limitations of Results
You agree not to use information obtained from the KYPD Services:
- As definitive proof of pedigree or purebred status
- For veterinary diagnosis or treatment without professional consultation
- In judicial or administrative proceedings
- For discriminatory, unlawful, or unethical purposes
Genetic results may be unexpected and may not align with observable traits or behaviors. You assume all risks associated with your use of the KYPD Services and results.
Refunds and Replacement Kits
Refunds
Refund eligibility, timing, and processing are subject to the terms disclosed at the time of purchase and applicable consumer protection laws. Refunds may not be available once a DNA sample has been submitted or processed.
Replacement Kits
If you require a replacement Know Your Pet DNA test kit, you may contact BioPet and provide the information associated with your original order.
BioPet may, at its discretion:
- Provide a replacement kit
- Charge a replacement fee and applicable shipping and handling costs
- Limit or deny replacement requests in cases of suspected misuse, fraud, or repeated requests
Replacement kit availability and pricing may vary by location.
Intellectual Property
All KYPD Services, reports, software, content, trademarks, and underlying technology are owned by BioPet or its licensors and are protected by applicable intellectual property laws. You may use your KYPD results and reports for personal, non-commercial purposes only. No rights or licenses are granted except as expressly stated in these Terms.
User Content
The KYPD Services may allow you to submit content such as photos, feedback, comments, or testimonials (“User Content”). You retain ownership of your User Content but grant BioPet a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, and display such content solely to operate, promote, and improve the KYPD Services, consistent with the Privacy Policy. Feedback and suggestions are considered non-confidential and may be used by BioPet without compensation.
Prohibited Conduct
You agree not to:
- Resell or redistribute KYPD test kits or Services
- Attempt to access data in bulk or without authorization
- Circumvent or interfere with security features
- Use automated tools (bots, scrapers, AI tools) to access the Services without permission
- Use the Services in violation of applicable law
Suspension or Termination
BioPet may suspend or terminate your access to the KYPD Services if you violate these Terms or misuse the Services. Where termination results from a violation, BioPet is not required to provide refunds. Applicable law may require notice or process in certain jurisdictions.
Limitation of Liability
To the maximum extent permitted by law:
- The KYPD Services are provided “as is” and “as available”
- BioPet disclaims all warranties, express or implied
- BioPet is not liable for indirect, incidental, consequential, or special damages arising from your use of the KYPD Services
Some jurisdictions do not allow certain limitations, so these limitations may not apply to you in full.
Transfer of Rights
BioPet may assign or transfer these Terms, including in connection with a merger, acquisition, reorganization, or sale of assets involving the KYPD Services. You may not assign or transfer your rights or obligations under these Terms without BioPet’s prior written consent.
Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Changes to These Terms
BioPet may update these Terms from time to time. Material changes will be communicated prior to taking effect. Continued use of the KYPD Services after changes become effective constitutes acceptance of the revised Terms.
